Este ensayo, motivado por una crítica de Riccardo Guastini, ilustra el papel de la lógica en el derecho y precisamente: a) en la construcción de la teoría del derecho, b) en el razonamiento y en los discursos desarrollados por las disciplinas jurídicas positivas y c) en los razonamientos y en las operaciones de operadores jurídicos y en particular de los jueces.

Las interpretaciones ascética y vitalista del eidos son incapaces de pensar a fondo su relevancia fenomenológica. Siempre parece que se valora más su perímetro y cerco, al servicio de la clausura y la consolidación de la unidad, que la diversidad intraeidética, infinita o empíricamente abierta. Más allá de lo típico, las rutinas y asentamientos mundanos, la diversidad intraeidética es críticamente eficaz sobre todo en la periferia, al tiempo que propicia la flexibilidad y dilatación interior de cada eidos. Esta problemática es (...) decisiva cuando se trata de pensar la dimensión proteica e hibrida de la cultura humana, así como la posibilidad de diversidad y cordura en un mundo complejo y en expansión.The ascetic and vitalistic interpretations of eidos are unable to think thoroughly its phenomenological relevancy. It always seems that the perimeter and boundary of eidos, at the service of the closure and consolidation of the unity, is more valued than intraeidetic diversity, infinitely or empirically opened. Beyond the typical, mundane routines and settlements, intraeidetic diversity is critically effective especially in the periphery, while enabling the flexibility and inner expansion of each eidos. This problem is crucial when it comes to thinking about the protean and hybrid dimensions of human culture, as well as the possibility of diversity and sanity in a complex and expanding world. In a program named "SATURN" (Student Athletic Testing Using Random Notification), each (...) school in the Oregon public-school system may implement a mandatory drug-testing program for high school student athletes. A prospective study to identify drug use among student-athletes, SATURN is designed both to evaluate the influence of random drug testing and to validate the survey data through identification of individuals who do not report drug use. The enrollment of students in the drug-testing study is a requirement for playing a school sport. In addition to the coercive nature of this study design, there were ethically questionable practices in recruitment, informed consent, and confidentiality. This article concerns the question of whether research can be conducted with high school students in conjunction with a mandatory drug-testing program, while adhering to prevailing ethical standards regarding human-subjects research and specifically the participation of children in research. Relationships between degree/area of academic formation and religious and Darwinian views are controversial. This study aimed to compare the religious beliefs and acceptance of Darwinian evolution between two contrasting South American scientific communities (Chile and Colombia), accounting for different degrees and areas of academic formation. In 2018, 115 last year bachelor students (surveyed as freshmen in 2014 for a previous study) from Chile, and 283 first/last year bachelor students, graduate students, and professors from Colombia, all belonging to biology, chemistry, or (...) physics, were surveyed. Chilean students/faculty were significantly more agnostic/atheist, more accepting of Darwinian evolution, and less creationist than their Colombian counterparts. Academic degree and area differently affected these views in both countries, as only in Chile there was a clear tendency among biologists and physicists with higher degrees to hold less religious and creationist views. Marked differences between the history, socioeconomic contexts, and especially in high school and university curricula of both countries might explain these results. (shrink)

At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs (...) from social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

Public health ethics, like the field of public health it addresses, traditionally has focused more on practice and particular cases than on theory, with the result that some concepts, methods, and boundaries remain largely undefined. This paper attempts to provide a rough conceptual map of the terrain of public health ethics. We begin by briefly defining public health and identifying general features of the field that are particularly relevant for a discussion of public health ethics.Public health is primarily concerned (...) with the health of the entire population, rather than the health of individuals. Its features include an emphasis on the promotion of health and the prevention of disease and disability; the collection and use of epidemiological data, population surveillance, and other forms of empirical quantitative assessment; a recognition of the multidimensional nature of the determinants of health; and a focus on the complex interactions of many factors—biological, behavioral, social, and environmental—in developing effective interventions. Eusociality is broadly defined as: colonies consisting of overlapping generations, cooperative brood care, and a reproductive division of labour where sterile (or non-reproductive) workers help the reproductive members. Colonies of many complex eusocial insect species (e.g. ants, bees, termites) exhibit traits, at the collective level, that are more analogous to biological individuals rather than to groups. Indeed, due to this, colonies of the most complex species are typically a unit of selection, which has led many authors to once again (...) apply the concept of the superorganism to eusocial insects. However, unlike W. M. Wheeler, who originally employed the concept from a physiological and evolutionary perspective, today the superorganism is typically understood only from an evolutionary perspective, using group selection. This is because of the widely held view that eusocial colonies are self-organized systems. According to this view, even the most complex eusocial systems can be explained by appealing to a set of local interactions between parts of an initially disordered system (i.e. self-organization), without the need of any hierarchical control. In this paper we challenge the presupposition that hierarchical control and regulation is not possible in complex eusocial colonies. Using a case study of honey bees (Apis mellifera), we develop an alternative to the self-organization approach, that focuses on the hierarchical nature of the organization of complex eusocial systems—that we refer to as the hierarchical-organizational approach. In addition, we will analyse how colonies of eusocial insects show a complex set of interactions between the different organisms that bring forth a new cohesive collective organization, and how in turn the constitutive entities of this collective organization are transformed in this process. This paper argues that an inter-identity (namely the superorganism) emerges at the collective level in complex eusocial colonies, such as honey bees, due to the hierarchically-organized network of interactions within the colony. Our question, in this paper, is about the plausibility of the expressivist account of one’s self- attribution of mental states. More to the point, we will strictly follow the principle of charity as a mean to show that an expressivist philosopher can have good and reasonable answers to the set of objections put together in so called “Geach’s point”. Using this method, we hope to give enough evidences that an expressivist philosopher has enough resources to build a plausible explanation (...) for one’s attribution of mental states to herself. The law of prior entry was one of E.B. Titchener’s seven fundamental laws of attention. According to Titchener : “the object of attention comes to consciousness more quickly than the objects which we are not attending to.” Although researchers have been studying prior entry for more than a century now, progress in understanding the effect has been hindered by the many methodological confounds present in early research. As a consequence, it is unclear whether the behavioral effects reported in (...) the majority of published studies in this area should be attributed to attention, decisional response biases, and/or, in the case of exogenous spatial cuing studies of the prior-entry effect, to sensory facilitation effects instead. In this article, the literature on the prior-entry effect is reviewed, the confounds present in previous research highlighted, current consensus summarized, and some of the key questions for future research outlined. In particular, recent research has now provided compelling psychophysical and electrophysiological evidence to support the claim that attending to a sensory modality, spatial location, or stimulus feature/attribute can all give rise to a relative speeding-up of the time of arrival of attended, as compared to relatively less attended stimuli. Prior-entry effects have now been demonstrated following both the endogenous and exogenous orienting of attention, though prior-entry effects tend to be smaller in magnitude when assessed by means of participants’ performance on SJ tasks than when assessed by means of their performance on TOJ tasks. Despite the persistent affirmations of the ill-informed, the great promise of semiotics is the possibility it represents of welding together both language and text analysis and the analysis of pragmatic and ideological context. It is merely a matter of judicious planning if attention has so far been directed primarily to distinctive aspects of techniques and texts rather than to the general character of the frames of reference within which they operate. And yet, as we know, investigations of the total functioning (...) of culture have been carried out with far-reaching results. This has been so particularly when the areas examined have been those, like the mass media, in which the weight of individual contribution is small. For culture in the widest sense of the term., the most highly elaborated hypotheses are those put forward by the Soviet semioticians, Lotman first among them. It is with these that I mean to deal here in an act of criticism which may also prove to be one of integration. Lotman's thought is clearly still in the making, and rather than follow out its likely developments, or, it may be, contradictions, it seems more helpful to get into its seams in an attempt to perceive alternative interlacings. In this article, I am starting with a question which many years ago was at the center of the debate on structuralism. Are structures to be found in the object or in the subject ? If we take one of the famous analyses by Jakobson, we ascertain that as long as attention is brought to bear on the graphemic or phonological elements, or on rhymes and accents, then the objectivity of the examination is incontestable. The absolute or relative computation of (...) phonemes or groups of phonemes and the specification of their place in the text are independent of the critic's subjectivity. Subjectivity begins to impose itself when categories like "abstract" and "concrete" or "metaphor" and "symbol" are introduced, and even more so when these categories are grouped into classes the denomination of which does not have its basis in the data offered by the text but in nomenclative schemata developed by the critic . This paper intends to explore an aspect of Blumenberg’s metaphorology as memory of mankind and the ethical commitment derived from it. It is seen as the culmination of the fight that the human being maintains against the senselessness of reality. It manifests itself and it is perceived by a human being as theimmensurability of world time and life time (i.e. that the human being is born and dies), that impedes the human being from having all of the world i.e. the (...) satisfaction of its infinite desires. In the fight against finity technology and money play a vital role. They have in common the power to enable an expansion of human capacities over the boundaries of factual existence: through technology and money the human being can do more or, do the same in less time. That is: tobring closer life time and world time. But in this process the instrumental character of technology and money causes homogenisation in the societies where they thrive. That’s one of the characteristics of globalization. This homogenisation is to be understood as the forgetting of other essential possibilities of the human creation of meaning. Thus, what technological and monetary processes construct on one side, come to be destroyed on the other side. Blumenberg’s metaphorology is the adequate response: it is understood both as the self-consciousness of the process of reason in its making sense of the universe, and as an “ideal store” of everything the human being has come to make in this process. No Discurso sobre as Ciências e as Artes, seu primeiro discurso, Rousseau defende a polêmica tese de que o progresso das ciências e das artes, contrariamente ao que pretendia o Iluminismo, estava contribuindo mais para a degeneração dos costumes e da sociedade do que para seu aperfeiçoamento. O Primeiro Discurso foi escrito em 1749, há quase 300 anos. Nesse período, a ciência e a nossa compreensão sobre ela mudaram profundamente. Mais importante, nesse período surgiu da ciência algo imprevisto para Rousseau (...) no Primeiro Discurso: a tecnologia moderna. A proposta deste trabalho é, pois, revisitar as críticas de Rousseau à ciência com um olhar contemporâneo, buscando avaliar o quanto daquelas críticas ainda faz sentido nos panoramas científico e social atuais. Para tanto, classificamos esquematicamente as críticas de Rousseau em dois grupos: as que acusam a inutilidade das ciências e as que acusam como nociva a sofisticação que as ciências produzem na sociedade. Defenderemos que o surgimento da tecnologia moderna tornou obsoletas as críticas quanto à inutilidade ao mesmo tempo que potencializou as críticas quanto à sofisticação. Assim, uma parte importante de suas críticas à ciência pode ser recuperada, vestida em nova roupagem e aplicada justamente na crítica à tecnologia.: In the Discourse on the Arts and Sciences, his first discourse, Rousseau supports the polemical thesis according to which the scientific and artistic progress were contributing more to moral degeneration than to the improvement of society. The First Discourse was written in 1749, almost 300 years ago. Since then, science and our understanding of it have changed completely. More important, in this period something new and unpredictable from Rousseau's view point has emerged from science: modern technology. In this essay, thus, we intend to review Rousseau's criticisms of science from a contemporary perspective to evaluate if they are still appropriate in face of our transformed society and science. To do so, we classify Rousseau's criticisms in two groups: those which claim that science is futile and those which blame science for the sophistication of society. We argue that the emergence of technology has become obsolete the criticisms of the first group meanwhile has made powerful those of the second group. O objetivo deste artigo é o de explorar as relações entre psicologia, metafísica e literatura, a partir do exame do Ensaio sobre os dados imediatos da consciência; mais exatamente, a partir da compreensão dos "sentimentos profundos", que representa, no Ensaio, o momento privilegiado para apreender a estrutura temporal da consciência. Porém, o presente estudo não abordará unicamente o texto de Bergson, suas descrições dos sentimentos profundos (como as emoções estéticas e morais), o que muito provavelmente seria repetitivo. O uso de (...) um exemplo extraído da própria literatura (no caso, o romance Grande sertão: veredas, de Guimarães Rosa) será imprescindível aqui para compreender a possibilidade de uma descrição qualitativa do "fluxo da consciência", revelando sua estrutura temporal. A partir disso, espera-se determinar com um pouco mais de clareza as interações entre psicologia, metafísica e literatura, na filosofia de Bergson. This paper aims to explore the relation between psychology, metaphysics and literature, through an examination of Bergon's Time and Free Will: An Essay on the Immediate Data of Consciousness, or, more precisely, through the description of "deep feelings", which represent in the Essay a privileged moment for understanding the temporal structure of consciousness. However, this study will not be restricted only to Bergson's text and its descriptions of deep feelings (such as aesthetic and moral emotions), which would probably be repetitive. Instead, we shall use a work of literature (Guimarães Rosa's novel, Grande sertão: veredas) to exemplify the possibility of a qualitative description of "stream of consciousness", revealing its temporal structure. We hope in this way to clarify the interaction between psychology, metaphysics and literature in the philosophy of Bergson. (shrink)

This article is an introduction to the Synthese Special Issue, Natural Kinds: Language, Science, and Metaphysics. The issue includes new contributions to some of the main questions involved in the present philosophical debates on natural kinds and on natural kind terms. Those debates are relevant to philosophy of language, philosophy of science, and metaphysics. In philosophy of language it is highly debated what the meaning of natural kind terms is, how their reference is determined, as well as whether there are (...) differences and similarities between the semantics of natural kind terms and that of other sorts of kind terms. In philosophy of science, natural kinds are relevant because they are the basis for scientific classifications and play an explanatory role in scientific theories; thus one aim of science is to discover natural kinds and theorize about them. Natural kinds are also relevant in metaphysics, where many questions involving natural kinds are debated and especially those concerning the sort of entities we refer to when using natural kind terms, i.e., the ontological status of natural kinds; in this regard there are different views, such as conventionalism, realism and essentialism. Another metaphysical question is what it is that characterizes the naturalness of kind divisions. The introduction sketches the antecedents of some of the present views on natural kinds and natural kind terms, and indicates some of the topics dealt with in the articles that make up the issue, which can be classified in the following groups: the metaphysics and epistemology of natural kinds the semantics of natural kind terms and other kind terms questions on species and other related issues on natural kinds. Despite the remarkable advances in behavioral and brain sciences over the last decades, the mind/body (brain) problem is still an open debate and one of the most intriguing questions for both cognitive neuroscience and philosophy of mind. Traditional approaches have conceived this problem in terms of a contrast between physicalist monism and Cartesian dualism. However, since the late sixties, the landscape of philosophical views on the problem has become more varied and complex. The Multiple Realization Thesis (MRT) claims that (...) mental properties can be (or are) realized, and mental processes can be (or are) implemented by neural correlates of different kinds. Thus, MRT challenges the psychoneural type-identity theory and the corresponding reductionism. Many philosophers have acknowledged the a priori plausibility of MRT. However, the existence of empirical evidence in favor of intraspecific, human multiple realizations of mental processes and properties is still controversial. Here we illustrate some cases that provide empirical evidence in support of MRT. Recently, it has been proposed that foveal agnosic vision, like peripheral vision, can be restored by increasing object parts’ spacing (Strappini et al., 2017a; Crutch and Warrington, 2007). Agnosic fovea and normal periphery are both limited by crowding, that impairs object recognition, and provides the signature of visual integration. Here we define a psychological property of restored object identification and we cross-reference the data of visually-impaired patients with different etiologies. In particular, we compare the data of two stroke patients, two patients with posterior cortical atrophy (PCA), six cases of strabismic amblyopia, and one case with restored sight. We also compare these patients with unimpaired subjects tested in the periphery. We show that integration (i.e. restored recognition) seems to describe quite accurately the visual performance in all these cases. While the patients have different etiologies and different neural correlates, the unimpaired subjects have no neural damage. Thus similarity in the psychological property given the differences in the neural substrate can be interpreted in relation to MRT and provide evidence in its support. Finally, we will frame our contribution within the current debate concerning MRT providing new and compelling empirical evidence. (shrink)

Partiendo del eje reflexivo que brinda la ambigüedad de la Cultura como atolladero y trascendencia de los individuos, el presente estudio toma dos circunstancias de nuestra situación cultural (hipersubjetividad y superconductividad) como base para una reflexión en torno a las posibles deformaciones del proceso postmoderno de personalización y sobre sus correspondientes enmiendas -mediación densa (resistencia), inspiración (recogimiento) y ruptura de la inmanencia (responsabilidad)-, que puedan reorientar el desarrollo del individuo como Uno entre Otros.

: President Clinton's charge to the Advisory Committee on Human Radiation Experiments included the identification of ethical and legal standards for evaluating government-sponsored radiation experiments conducted during the Cold War. In this paper, we review the traditional account of the history of American research ethics, and then highlight and explain the significance of a number of the Committee's historical findings as they relate to this account. These findings include both the national defense establishment's struggles with legal and insurance issues concerning (...) human experiments, and the medical profession's perspective on human experimentation in the years following the Nuremberg Medical Trials. We conclude that the Committee's work both enriches the traditional view of the history of research ethics and opens important new areas for study. (shrink)

In Amerindian ontologies, hallucinations or visions, rather than being dismissed as delusions or symbolic constructs, are recognized as means of perceptual access to physical reality. Lowland South American shamans claim to be able to diagnose and treat infectious diseases, and to assess the status of wildlife resources through interactions with pathogenic agents perceived in visions. This essay examines some perceptual capabilities that shamans might be employing to explore their physical reality. The structure of the eye affords a form of microscopy (...) of retinal structures and of objects flowing within them, including cells and microbial agents during systemic infection. Lowland South American shamanic practices involve optical and physiological conditions that optimize entoptic microscopy. Images of those visions display the characteristic features of shadow formation, confirming their microscopic origin. This phenomenological access to the microscopic world and similarities with the panorama depicted by current microbiology indicate the commensurability of these forms of knowledge. (shrink)

La presente contribución explora la posibilidad de una más intensa proximidad entre Husserl y Heidegger. De entre las muchas opciones en este sentido, el autor elige situarse en lo que considera que habría sido el aprendizaje heideggeriano de la epojé según la praxis fenomenológica husserliana. A tal efecto, asumiendo riesgos, toma dos hitos, como sería la distinctio phaenomenologica y la indubitabilidad de la percepción inmanente, pero no como si la “inmanencia” fenomenológica simplemente tuviese una vigencia reflexivo-teorética, sino como recurso para (...) una hospitalidad reflexiva capaz de proteger la presencia contra la duda, el psicologismo o el naturalismo, a favor de la presencia por sí misma de lo que se da. A tal efecto, el autor busca insistir y ahondar en otra zona peligrosa atrayéndola a la plenitud del florecer sin porqué de la Rosa de Silesius, tan importante en Heidegger. Finalmente, se intenta rescatar la Presencia ya en las lindes del Noema-Poema. (shrink)

El presente artículo se propone indagar en la praxis de extrañamiento que lleva acabo Gómez de la Serna en El Rastro (1914), praxis que será esencial de cara a comprender uno de los vectores fundamentales de la (ulterior) objetología surrealista. Dicha praxis comprende al menos ocho prácticas o posibilidades de deshacer que afectan al Límite (que discrimina y jerarquiza), al Futuro (ingenuo y dictatorial), a la familiaridad hogareña burguesa (que encarcela y amodorra), a la funcionalidad utilitaria (que banaliza), a la (...) idealidad falsa (de los prestigios de la ciudad), a la propiedad (de nuestras cosas), a uno mismo (praxis de desasimiento), y al propio texto. Estas prácticas configuran un extrañamiento masivo, aunque sereno, con una clara proyección de trascendencia poética, existencial y metafísica. (shrink)

In the digital era, video games have become a major propaganda tool, used for political purposes by state agents and different organisations, including extremist groups. Similarly, some titles have structured their narratives with an educational and awareness-raising purpose, denouncing the senselessness and violence of different terrorist groups. In this article, we will present a general theoretical framework on how video games have been used in the virtual war on terrorism, either in favour of or against it, either by means of (...) special creations or through modifications of famous war games. Next, we will include a case study referring to Spain, analysing the representation in this video game format of the ETA problem or the 11-M jihadist attacks. As a preliminary result, we would like to highlight the importance of this interactive format today, whether from a propaganda, educational or informative point of view. (shrink)

Tras reconocer el papel decisivo que juega en el pensamiento husserliano la intersubjetividad en su estructura trascendental, y, respecto a la Einfühlung y la Fremderfahrung, el importante papel que desempeña la Umfiktion, el presente artículo desarrolla la posibilidad experiencial y de senti-do que supone ese extraño personaje que es la Voz Narrativa heterodiegética. En concreto, la Voz Narrativa como Otro subsidiario en el caso de que los personajes duerman o hayan muerto. Esto permite pensar al Testigo como dativo de manifestación (...) en off en soporte último del continuum de la fenomenalidad. Con ello, se trata de profundizar en la tesis husserliana acerca de la inmortalidad de la subjetividad trascendental y extraer algunas conclusiones metafísicas y éticas. El artículo se basa en un texto de Muñoz Molina en el que comentaba un pasaje de Al faro, de V. Woolf.Recognizing the decisive role in Husserl's thought of the intersubjectivity in its transcendental structure, and, for the Einfühlung and Fremderfahrung, the important role of Umfiktion, this article develops the experiential possibility and the possibility of meaning that assumes the Strange character who is the heterodiegetic Narrative Voice. Specifically, the narrative voice as subsidiary Other in the event that the characters sleep or have died. This suggests the Witness as dative of manifestation in off as last stand of the continuum of phenomenality. With this, it is deepening the Husserlian thesis about the immortality of transcendental subjectivity and draw some metaphysical and ethical conclusions. Specific classes of cyberspaces emphasize different types of digital transactions given the user’s context, thus making it essential to take into account what these environments can afford. In this way, we can portray the niches of technological use as ecologies of particular possibilities and compare how they differ between distinct spheres of human life. The present research is focused on describing the conceptual integration of a taxonomic crossover between Virtual Learning Environments and Educational Affordances of Technology, while also performing empirical (...) testing and determining the psychometric properties in a scale regarding the aforementioned taxonomy. The study sample consisted of 320 students in the departments of foreign languages from three different universities in Sonora. Students were given a questionnaire of 21 items organized into four subscales with a Likert-type response option to measure the notions concerning their usage of Virtual Learning Environments. Internal consistency procedures and confirmatory factor analysis by means of Cronbach’s alpha and Structural modeling support the derived factorial structure, which contains Cyber-Communications, Virtual Behavior Settings, Virtual Communities, and Availability and Access to Connectivity. This structure traces the environmental properties perceived by learners in a virtual environment. Results sustain the initial conceptual construction regarding the proposed taxonomy, conclude that the ‘Virtual Learning Environments Questionnaire’ demonstrates adequate psychometric properties, and validate it as a fitting measure to assess the perceived psychological experience of students in a digital educational setting. El presente artículo se propone indagar en la praxis de extrañamiento que lleva acabo Gómez de la Serna en El Rastro, praxis que será esencial de cara a comprender uno de los vectores fundamentales de la objetología surrealista. Dicha praxis comprende al menos ocho prácticas o posibilidades de deshacer que afectan al Límite, al Futuro, a la familiaridad hogareña burguesa, a la funcionalidad utilitaria, a la idealidad falsa, a la propiedad, a uno mismo, y al propio texto.
